Update to Texas Sexual Harassment Laws

On September 1, 2021, new sexual harassment laws came into effect in Texas. These laws were enacted in response to concerns about the prevalence of sexual harassment in the workplace and the need for greater protections for employees.

One of the most significant changes is the expansion of the definition of sexual harassment. The new laws broaden the definition to include any unwelcome conduct of a sexual nature, including verbal, physical, or visual conduct. This ensures that all forms of sexual harassment are covered, regardless of the specific conduct involved.

The new laws also require employers to provide employees with training on sexual harassment prevention and reporting. Employers must provide this training to all employees, not just supervisors or managers, and the training must be interactive and presented in a manner that is easy for employees to understand.

Additionally, the new laws extend the time limit for filing a sexual harassment claim from 180 days to 300 days. This gives employees more time to file a claim if they are unable to do so within the previous time limit.
